This Privacy Policy and these General Terms and Conditions explain in detail how we process your personal data obtained by browsing our website or webshop and placing orders offered by our webshop Ograje Kočevar.


A user's Purchase is defined as placing an Order for one or more items through our webshop.

Orders in our webshop | Ograje Kočevar may be placed at any time in the week, 24/7, meaning you may perform your purchase at any time you so desire. Delivery of purchases is performed as defined in the paragraphs below.

By placing an order through the Ograje Kočevar webshop on our website, you as the user and purchaser will have to provide the following data:

  1. Valid e-mail address;
  2. Name and Surname;
  3. Mobile phone number;
  4. Address for goods delivery and invoicing.

It is important that the above data is complete and accurate as otherwise the user may not be able to complete the purchase process and the order will be cancelled.

By using our webshop the user signifies his or her agreement to be bound by these General Terms and Conditions valid at the time of purchase (placing an order).


Only registered users may place orders in our webshop Ograje Kočevar.

When registering at the webshop a user obtains his username which is equal to the said user's e-mail address. The password is individually chosen by the user kept irreversibly encrypted in our database. Should the user at any time wish to change his e-mail address, password and other details he may do so through the User profile subpage.


Personal information is data, which directly or indirectly identifies you as a unique user. »Indirect identification« means identification in combination with other information such as, but not limited to, your name, postal address, e-mail address, telephone number, identification numbers, (geo-)location data and other various identifiers.


If you are only visiting our webpage | Ograje Kočevar, we only collect cookie data.

Should you use our contact forms or perform a purchase on our Webshop Ograje Kočevar, we may collect other personal data required to reply effectively or finish processing your order. This personal information is as follows:

  • Other data necessary for invoicing (name, surname, address, postal code, business VAT identification number)

Reasonable physical, electronic and administrative safeguards prevent the accidental or deliberate destruction, loss, tampering, accidental disclosure or unauthorized access to your data.  Our standards and procedures governing the security of information follow the governing internationally accepted standards and are updated accordingly taking into consideration our business requirements, changes in technology and regulatory requirements. Your data can be accessed only by employees and potential third party providers of services who perform functions on our behalf directly related to business reasons for which the data was collected and processed in the first place (business »need-to-know«).

If you bought one of our products, the personal information we collect and process is directly related to the execution of the contract, i.e., to fulfill the order and notify the customer regarding additional details, changes pertaining to the order, installation instructions and user manuals, warranty terms and goods delivery.

Should the user subscribe to our electronic newsletter, he or she consents to us processing his or her name and e-mail address for marketing purposes – notifications about ongoing promotions, new product launches, news and articles published on the Ograje Kočevar website.

Ograje Kočevar will not share, sell, lend, transmit or in any way pass your personal data to third parties. Exceptions to the above may happen if any of the events below occur, in which case the data will be adequately processed and protected in line with applicable standards and regulations:

Business Transfers: As we continue to develop our business, we might reorganize our company, sell or buy other businesses or services. In such transactions, user or customer information may be one of the transferred business assets but will always remains subject to the promises made in any pre-existing Privacy Policies unless, the user consents otherwise. Regardless of the case we will always inform affected users before such data becomes governed by a different Privacy Policy.

Public authorities: Your personal data will be divulged to public authorities only when the applicable national or European law dictates it. Ograje Kočevar will, for example, respond to requests for data mandated by courts or law enforcement agencies and other public authorities which may include authorities from other European Union member states.


We process your personal information to comply with legal obligations, to prevent and prohibit unlawful exploitation or misuse of our provided services, furthermore fraud and abuse prevention to ensure stable fuctioning of our systems and services, to protect our customers as well as ongoing execution of information security measures, technical fixes and continuous improvement of our services.

Data collected and processed by the website and webshop may be used for the protection of our legal interests, including but not limited to legal actions, legal and out-of-court settlements such as arbitration.


Purchase, Order and Prices

The contract between Ograje Kočevar and the Purchaser in the webshop is concluded at the moment when Ograje Kočevar sends the Purchaser a written electronic communication confirming the receipt of his order placed through the webshop (first e-mail - 'order confirmation'). From this moment onward all prices and other Terms and Conditions are fixed and binding for both Ograje Kočevar as well as for the Purchaser for the duration of this contract. The contract is stored in electronic form on the server of Ograje Kočevar and is available upon written request. A copy of the Purchaser's order is also sent to his or her e-mail address.

Right to withdraw and goods replacement

In accordance to the Slovenian Consumer Protection Act (ZVPot) the consumer has a right to notify the company of withdrawing from the contract within 15 days of goods receipt without having to state the reason for his or her decision. The consumer is obliged to return the goods within 30 days of goods receipt.

The only costs borne by the consumer when withdrawing for the contract are direct costs associated with the goods return (return shipment costs). The notice of withdrawal is sent in written form to the e-mail

Should the consumer already have received the goods and has chosen to withdraw from the contract, then the goods in question must be returned in the original packaging, unused, undamaged and unaltered within 30 days after goods receipt. The returned quantity must be equal to the original quantity dispatched unless the goods were destroyed, lost or reduced without consumer's intent. We reserve the right to charge compensation or withhold part of payment should the returned goods have been stripped of their original packaging or if either the packaging or the product has been excessively damaged or the product shows signs of excessive use going beyond that which would necessary to find out its properties by testing. We urge the consumer to carefully unpack the products after collecting them or having them delivered to avoid additional costs.

The consumer relinquishes his or her right to withdraw from contracts which concern goods manufactured in accordance to the exact instructions of the consumer or goods that may have been modified to the consumer's personal or specific needs or may because of their nature not be suitable for return. Examples include customized dimensions, special opening hinges, customized coating, special infill, etc.

Should the consumer choose to have the goods replaced, he or she returns the existing goods and will receive the replacement goods. In this case the consumer bears the return shipping costs and the shipping costs of replacement goods. Transport costs are covered by the seller when the goods are returned as part of a warranty claim.

Damaged goods

The purchaser should inform us within the legally defined period should he or she discover any hidden damages or faults. After informing us we have the right to inspect the goods and reply to his or her claim and proceed with necessary further steps.

The rights and obligations of both parties are detailed in the Consumer Protection Act (ZVPOT).

Payment methods

The Ograje Kočevar webshop supports the following payment methods:

  • »by credit card« - Secure payment by credit card (Mastercard, Visa, Visa Electron, BA Maestro) through the webshop interface,
  • »bank transfer« - Bank transfer after confirming your order and obtaining the payment reference and payment purpose numbers (SEPA or SWIFT wire transfer),
  • »in store pickup and payment« - In the Ograje Kočevar store (Tovarniška cesta 11c, 3312 Prebold) while picking up the goods. We accept cash, debit or credit card (Activa, Mastercard, Visa, Visa Electron, BA Maestro).

Shipping costs are specified before the Purchaser finishes placing his or her order. Shipping costs are calculated based on the total weight of selected items in the shopping basket.

If »in store pickup and payment« is selected, no shipping costs are calculated as the Purchaser will pick the goods up at the seat of Ograje Kočevar in Prebold.

Goods Delivery

Ograje Kočevar makes use of its own and outside logistics services for deliveries. Delivery takes place every workday between 7:00 and 17:00. Deliveries will be made to the shipping address input by the Purchaser at the time of placing an order in the webshop.

Shipping costs

Shipping costs are specified before the Purchaser finishes placing his or her order and will be shown in on the order confirmation. Shipping cost calculation is based on the total weight of selected items in the shopping basket.

If »in store pickup and payment« is selected, no shipping costs are calculated as the Purchaser will pick the goods up at the seat of Ograje Kočevar in Prebold.

Goods dispatch

The Ograje Kočevar webshop strives to prepare and dispatch the ordered goods in the shortest lead time possible. Usual lead times depend on the type of goods ordered, the usual lead time is 2 to 5 working days for small merchandise (clips, caps, nuts and bolts), fencing panels and posts from stock.

We replenish our stocks according to the production cycles below:

Our sales agents will inform the Purchaser via e-mail or by phone call regarding ordered items which due to unforeseen circumstances cannot be delivered within the scheduled delivery time.


Under the GDPR act individuals have the following rights:

The right to access and to be informed: You always have the right to access your data and to be informed how it is being processed. In particular (a) the purpose of processing; (b) types of data being processed; (c) users or categories of users to which your data was divulged; (d) retention periods; (e) when your personal data was gathered from other sources – information pertaining to said sources.

The right to rectification: You have the right to request rectification if the collected personal data is inaccurate or incomplete.

The right to erasure: You have the right to have your personal data erased when one of the reasons holds: (a) the data is no longer necessary for the purpose for which it was originally collected or processed; (b) when you withdraw your consent and there is no lawful basis for holding the data; (c) when you object the processing the data and there is no legitimate interest to continue; (d) when the data was processed unlawfully.

The right to restrict processing: You have the right to request the restriction or suppression of the processing of your personal data for a set period of time when one of the reasons holds: (a) you contest the accuracy of your personal data while are verifying it within this period; (b) the data has been unlawfully processed and you oppose the erasure and request restriction instead; (c) we no longer need the data, but you need us to keep it in order to establish, exercise or defend a legal claim; (d) you have objected to us processing your data and we are considering whether our company's legitimate grounds override those of the individual.

In case the processing of your personal data was restricted, then this type of personal data with the exception of its storage will only be processed when you consent to it or if other legitimate grounds exist which may override the restriction.

Before the restriction is lifted we will notify the individual in question.

The right to data portability: You have the right to obtain and reuse your personal data for your own purposes when the lawful basis for the processing of this information was consent or the performance of a contract and the data processing was carried out by automated means. The personal data provided will be in a format that is structured, commonly used and machine-readable. You may request and provided it is technically feasible, your personal data can be forwarded to another data controller directly.

The right to object: When we are using your personal data for direct marketing you may object to this processing.

The right to file a complaint with the ICO: Should we not respond to your written request within the legally stipulated time period, you may file a complaint with the ICO.

In case you wish to enforce one of the rights above, please send us your written request via e-mail to We will respond within the legally stipulated period of one month. In case of a complex request or when receiving a number of requests from the individual we may extend this deadline by a further two months in which case we will inform you of it.


Ograje Kočevar stores your personal data up to the point you unsubscribe from our newsletter.

Ograje Kočevar keeps your personal information as required by law for tax and accounting purposes. After the legally required amount of time has passed we delete this data. Based on tax laws we are required to keep invoices and invoice-related data for a minimum of 10 years.

Data which is required to confirm the deletion of personal data and personal information (i.e., an audit trail) together with data of persons who explicitly do not wish to be contacted by Ograje Kočevar will be kept. This data includes your e-mail address, name and surname.
